Right of Withdrawal

 

1.     Statutory right of withdrawal

1.1 By law, customers in the European Union have the right to cancel the purchase of an item within 14 days beginning from the day you receive, or a third party indicated by you (other than the carrier) receives, the last good ordered by you (if delivered separately).

1.2 In order to exercise your statutory right of withdrawal, you must notify us (Commercial and Plant, 4 Maltongate, Pickering YO18 7SE, Tel: (0) 7817 432 224, Email: info@cplant.uk) of your decision to cancel in a clear declaration (e.g. by sending a letter by mail or email).

1.3 The withdrawal deadline shall be deemed to be met if you have sent the communication concerning the exercise of the right of withdrawal before the expiry of the deadline.

2.     Consequences of withdrawal

2.1 If you cancel, you must return the item to us without delay and no later than 14 days from the date on which you notify us of your cancellation. As soon as we receive the item, we'll refund the relevant part of the purchase price for that item together with the standard postage charge, corresponding to the least expensive type of delivery offered by us. We can't refund any priority, express or courier component of the postage charge.

2.2 We will use the same payment method you used for the original transaction in order to reimburse you unless otherwise expressly agreed; you will not be charged a fee for this refund. We will withhold the reimbursement until we have received the returned item or until you have provided proof that you have returned the item, whichever is earlier.

2.3 For your protection, we recommend that you use a recorded delivery service if the value of the return is more than £50.00. Please note that you'll be responsible for the costs of returning the item to us unless we delivered the item to you in error, or if the item is damaged or defective.

2.4 You will only be liable for any diminished value of the item if this loss in value is attributable to any use or handling of the item which is not deemed necessary in order to verify the condition, features and functioning of the item.

3.     Exclusions from the statutory right of withdrawal

3.1 The statutory right of withdrawal shall not apply in the following cases:

  • Delivery of items which are not prefabricated and have been manufactured on the basis of a personal choice or according to customer specifications, or of items which have clearly been tailored to the customer’s personal requirements.

  • Delivery of sealed items which are not suitable to be returned for reasons relating to health protection or hygiene if their seal has been removed after delivery.

  • Delivery of audio or video recordings or computer software in sealed packaging if the seal has been removed after delivery.

  • Delivery of newspapers, journals or magazines, excluding subscription contracts.
